PURPOSE AND SCOPE OF APPLICATION.

These conditions of use regulate access, navigation and use of the Website www.casalfefarma.com, without prejudice to the fact that Casalfe Farma reserves the right to modify the presentation, configuration and content of the Website, as well as the conditions required for its access and /or use. No está permitido y, por tanto, sus consecuencias serán de la exclusiva responsabilidad del usuario, el acceso o la utilización de la Web con fines ilegales o no autorizados, con o sin finalidad económica, y, más específicamente y sin que el siguiente listado tenga carácter absoluto, queda prohibido:

El incumplimiento de cualquiera de las anteriores obligaciones por el usuario, podrá llevar aparejada la adopción por Casalfe de las medidas oportunas amparadas en Derecho y en el ejercicio de sus derechos u obligaciones, pudiendo llegar a la eliminación o bloqueo de la cuenta del usuario infractor, sin que medie posibilidad de indemnización alguna por los daños y perjuicios causados.

Del mismo modo, la Web cuenta con áreas a través de las que los usuarios pueden participar, publicar contenidos propios y/o compartir contenidos, propios o publicados por Casalfe. Dichas áreas pueden ser propias de Casalfe y por tanto dependientes y controladas por ésta, o ajenas a Casalfe, tratándose de redes sociales independientes y ajenas a nuestra organización, respecto a las que no podemos responsabilizarnos, ni del correcto funcionamiento, ni las condiciones y políticas dispuestas por sus responsables, siendo el propio usuario el que deberá consentir y asumir en todo momento el tratamiento que se realice de la información publicada en dichas plataformas.

En todo caso, le informamos que cuando el usuario participe en cualquiera de estas zonas, el resto de usuarios de la Web podrá acceder y utilizar a todos los contenidos publicados por el usuario. Casalfe no puede controlar qué uso realizarán otras personas de tus contenidos y, por tanto, Casalfe no se hace responsable de ello. Casalfe le recomienda que no publique datos de carácter personal o materiales protegidos por derechos de propiedad intelectual e industrial o cualesquiera otros derechos.

Con el fin de que la Plataforma sea un entorno seguro y para proteger a nuestros usuarios, queda terminantemente prohibido publicar contenidos:

Que tengan por finalidad promover y/o publicitar la venta, el consumo y/o el uso de cualesquiera productos y/o servicios y, en particular, de medicamentos, preparados con fines medicinales y/o productos sanitarios, o influir en la toma de decisión de otros usuarios con respecto a un determinado tratamiento, o en la prospección comercial en favor de cualquier fabricante de medicamentos y/o de productos sanitarios.
Que incluyan publicidad o comunicaciones comerciales, para la emisión de mensajes con finalidad publicitaria o para la captación de datos con el mismo fin.

El usuario que incumpla estas prohibiciones será responsable de cualquier reclamación que se produzca como consecuencia de ello. Aunque no se produjera ninguna reclamación de un tercero, Casalfe se reserva la posibilidad de impedir el acceso a la Web o de la posibilidad de participar en el Blog a los usuarios que incumplan estas condiciones.

Casalfe no controla el contenido publicado por los usuarios en la Web y no asume responsabilidad alguna por estos contenidos. No obstante, Casalfe , se reserva la posibilidad de supervisar y/o moderar cualquier contenido publicado por los usuarios en el Blog y, en caso de que vulnere las presentes condiciones de uso o la Política de Privacidad https://casalfefarma.com/politica-de-privacidad/, de editarlo o eliminarlo. Asimismo, si Ud. encuentra alguna información o contenido en la Web que pueda ser no adecuada, contraria a la normativa vigente, o contraria a las condiciones dispuestas en esta Web, rogamos que lo ponga en conocimiento inmediato de Casalfe a través de los diferentes medios dispuestos para ello.

LEY APLICABLE Y JURISDICCIÓN COMPETENTE

Estas Condiciones de Uso se rigen por la ley española. Las partes se someten, a su elección, para la resolución de los conflictos y con renuncia a cualquier otro fuero, a los juzgados y tribunales del domicilio del usuario.

Para presentar reclamaciones en el uso de nuestros servicios el cliente puede dirigirse por correo a la dirección electrónica o física indicada en el apartado “Identificación”, comprometiéndonos a buscar en todo momento una solución amistosa del conflicto.

NORMATIVA APLICABLE

Las presentes condiciones se encuentran sujetas expresamente a lo dispuesto en la Ley 34/2002 de 11 de julio, de Servicios de la Sociedad de la Información y de Comercio Electrónico, Real Decreto Legislativo 1/2007, de 16 de noviembre, que aprobó la Ley de Consumidores y Usuarios, Real Decreto 1906/1999, de 17 de diciembre de 1999, por el que se regula la Contratación Telefónica o Electrónica con condiciones generales, Ley 7/1998, de 13 de abril, sobre Condiciones Generales de Contratación, Ley 7/1996, de 15 de enero de Ordenación del Comercio Minorista, Reglamento (UE) 2016/679, General de Protección de Datos y demás legislación de carácter general o de aplicación subsidiaria de conformidad con los principios básicos de ordenación del ordenamiento jurídico español.

Sin perjuicio de lo anteriormente dispuesto y la aplicación por defecto de la normativa nacional española, en tanto Casalfe no es un prestador de servicios de la sociedad de la información que oriente sus servicios hacia un Estado que no sea España, de conformidad con lo dispuesto en la Directiva y únicamente en aquellos casos en los que sea de obligado cumplimiento, Casalfe aplicará las condiciones particulares que pudieran ser de aplicación en el país de residencia del consumidor final.
